1. Contact Information for Law Enforcement Requests
Asianforme accepts official law enforcement and government inquiries via our dedicated email routing system and physical legal address:
- Official Email Channel: [email protected]. (Important: To ensure immediate escalation and prioritized processing, all law enforcement communications sent to this address MUST include "LAW ENFORCEMENT REQUEST" or "EMERGENCY DISCLOSURE REQUEST" in the subject line).
- Registered Address for Official/Legal Process:
All requests submitted via email must originate from an official government or law enforcement domain (e.g., .gov, .gsi, .police.uk, etc.). Requests sent from free/private email providers (such as Gmail, Yahoo, Hotmail) will not be processed. All requests must clearly identify the requesting agency, the investigating officer, and include an official callback telephone number and case reference for verification purposes.
2. Types of Requests Accepted
Asianforme accepts the following categories of requests from authorized Law Enforcement:
2.1 Emergency Disclosure Requests
Requests made in connection with an emergency involving an imminent risk of death or serious physical harm to a person, including but not limited to suspected trafficking, exploitation, or a missing or endangered minor. Emergency requests do not require formal legal process but must identify the requesting officer or agency, describe the nature of the emergency, and specify the information sought.
2.2 Legal Process Requests
Requests seeking the disclosure of account, content, or other user data pursuant to a subpoena, court order, search warrant, mutual legal assistance treaty (MLAT) request, or equivalent legal process valid under the laws of the Republic of Cyprus or European Union law.
Requests from Non-EU/EEA Authorities (Art. 48 GDPR Compliance): In accordance with European Data Protection Board (EDPB) Guidelines 02/2024, direct requests received from law enforcement or judicial authorities of a non-EU/EEA third country without an applicable international agreement (such as an MLAT) cannot be processed solely on the basis of the third country's legal order. Such requests will be evaluated on a case-by-case basis under a two-step assessment in accordance with Article 48 and Chapter V of the GDPR (verifying a valid legal basis under Article 6 GDPR and an applicable transfer mechanism or Article 49 derogation).
2.3 Preservation Requests
Requests to preserve existing account records and data pending the receipt of formal legal process. Preservation requests do not by themselves compel disclosure of the preserved data; disclosure requires a valid Legal Process Request as described in Section 2.2.
3. Requirements for Submitting a Request
To be processed, Legal Process Requests and Preservation Requests must be submitted on official law enforcement or government letterhead and must include, at a minimum:
- the name, agency, and title of the requesting officer or official, together with an official contact email and telephone number;
- a case or reference number, and the legal basis for the request (e.g., subpoena, court order, warrant, or applicable treaty mechanism);
- sufficient identifying information to locate the relevant account (e.g., username, profile URL, registered email address, or transaction reference); and
- a clear description of the specific data or records sought.
Legal Process Requests must comply with the requirements of applicable law, including the laws of the Republic of Cyprus and, where the requesting authority is located outside Cyprus, any applicable mutual legal assistance treaty or other recognized international cooperation mechanism. Asianforme reserves the right to require formal legal process valid in Cyprus before disclosing the contents of communications.
Emergency Exception: Where a request concerns an imminent threat to life or physical safety, Asianforme may, in its sole discretion, process the request under the simplified procedure described in Section 2.1, without requiring formal legal process. Asianforme reserves the right to request a follow-up legal process to confirm or supplement any information disclosed under this exception.
Non-EU/EEA Law Enforcement Notice: Requesting authorities located outside the EU/EEA are encouraged to submit requests through established Mutual Legal Assistance Treaties (MLAT) or diplomatic channels involving competent authorities in the Republic of Cyprus. Where a direct request is submitted, the requesting authority must provide sufficient detail regarding the legal basis, necessity, and proportionality of the request to allow us to conduct its mandatory legal assessment under EU and Cypriot data protection law (GDPR).
4. Response Timeframes
Asianforme endeavors to acknowledge receipt of all Law Enforcement requests within 2 business days.
- Standard Requests (Legal Process and Preservation Requests): Asianforme aims to complete its review and, where the request is valid and complete, respond substantively within 30 calendar days of receipt. More complex requests may require additional time, and Asianforme will notify the requesting authority accordingly.
- Emergency Disclosure Requests: Asianforme prioritizes and expedites the handling of verified emergency requests, and aims to respond as promptly as possible, and in any event within 24 to 72 hours of receipt, depending on the nature and verifiability of the emergency.
These timeframes are targets and not guarantees, and may vary depending on the completeness of the request, the volume of data sought, and legal or operational constraints.
5. Data Retention Policy
Asianforme retains certain account, usage, and transaction data for the periods described in our Privacy Policy, including for purposes of safety, security, fraud prevention, and compliance with legal obligations. Upon receipt of a valid Preservation Request, Asianforme will take commercially reasonable steps to preserve the specified existing records for an initial period of ninety (90) days, which may be extended upon a further written request from the requesting authority pending receipt of formal legal process.
For further detail on the categories of data we collect, the purposes and duration of processing, and the circumstances in which data may be disclosed to Law Enforcement or other government authorities, please refer to our Privacy Policy.
6. Our Commitment to Cooperation
Consistent with the Anti-Trafficking and Anti-Exploitation Policy and the Child Safety and Protection Against Sexual Abuse and Exploitation provisions of our Terms of Use, Asianforme is committed to:
- fully cooperating with law enforcement authorities and anti-trafficking task forces in the investigation and prosecution of suspected human trafficking, sexual exploitation, and related illegal activity;
- fully cooperating with law enforcement and child protection agencies in the investigation and prosecution of suspected child exploitation and Child Sexual Abuse Material (CSAM), including reporting to the National Center for Missing & Exploited Children (NCMEC), the CyberTipline, or the equivalent competent authority in the relevant jurisdiction;
- preserving and providing relevant account data, content, and evidence to Law Enforcement in accordance with valid legal process or applicable emergency-disclosure procedures; and
- proactively reporting confirmed or reasonably suspected trafficking, exploitation, or CSAM to the appropriate authorities, independent of any pending Law Enforcement request, as further described in our Acceptable Use Policy.
Where legally permitted, Asianforme may notify the affected user that a request for their data has been received; Asianforme will not provide such notice where prohibited by law, court order, or where notice would jeopardize an active investigation or emergency response.
7. Costs
Asianforme generally does not charge fees for standard Law Enforcement requests. For unusually broad, complex, or burdensome requests, Asianforme reserves the right to discuss reasonable reimbursement of costs with the requesting authority prior to processing.
8. Governing Law
These Guidelines, and Asianforme's handling of Law Enforcement requests, are governed by the laws of the Republic of Cyprus, without prejudice to any applicable international legal assistance mechanisms or the mandatory laws of the requesting authority's jurisdiction.
9. Changes to These Guidelines
We may amend these Guidelines at any time in our sole discretion. Any amendment will be posted on Asianforme.com and will take effect from the date of posting, unless otherwise stated.
